1) This warranty covers parts and labor purchased by the customer on the invoice that prompted the issuance of this warranty. Warrantor's obligation under this warranty is limited to replacing or repairing defective parts and correcting defectively furnished labor.
2) This warranty is effective beginning on the date work was performed and is valid for one year. The date that a service call is scheduled to investigate a possible warranty situation is considered the date of the claim. There is no grace period.
3) This warranty is extended to those customers whose accounts are in good standing and is not transferable.
4) This warranty does not cover damages caused directly or indirectly by parts and labor under warranty. It does not cover such things as loss of time, income, comfort, productivity, utility bills or any other consequential or incidental damages.
5) This warranty does not apply to any parts or labor that is designed to fail or that is known to have a short life span. For example fuses, batteries and disposable air filters have no warranty and are guaranteed only to be functional at the time of sale. Refrigerant that has leaked out of a system has no warranty.
6) Replacement parts and labor provided to the customer under this warranty carry only the balance of the original warranty.
7) This warranty is not valid if parts under warranty show obvious signs of abuse, lack of maintenance or have been used for a purpose they were not designed for.
8) The parts and labor under warranty can sometimes fail due to no fault of the warrantor. Parts related to but not part of the work performed by the warrantor can fail and adversely affect work otherwise covered by this warranty. Under these circumstances your warranty is not valid. The warrantor can not predict these events and can not be responsible for them.
9) In some circumstances High Performance Heating & Air may provide free parts or labor beyond that which is prescribed by this warranty. Such an act would be a gesture of good will and is at the sole discretion of High Performance Heating & Air. Such an act shall not be construed as a change in warranty terms or as a precedent for future warranty coverage.
10) The warranty terms herein apply to both written and implied warranties.

Third Party Warranties

In certain circumstances parts may have a warranty of longer than one year that is provided by the manufacturer or some other third party warrantor. If High Performance Heating & Air elects to handle such a third party warranty for the customer, then High Performance Heating & Air may require payment in full for all parts and labor furnished at the time the work is performed. High Performance Heating & Air will then make a claim in reasonable time with the third party warrantor. A check will be issued to the customer for whatever portion of the repair bill is covered by the third party warrantor once High Performance Heating & Air receives credit. In some cases there may be a warranty processing fee imposed by High Performance Heating & Air. For example, most compressors are quite substantial and can require considerable effort in processing a warranty claim. If a claim is denied by the third party warrantor then the customer will receive no reimbursement from High Performance Heating & Air. The customer will be given copies of any documentation provided to High Performance Heating & Air by the third party warrantor related to the denial if requested.

Third party warranties don’t always provide a labor allowance. The customer is responsible for all labor charges imposed by High Performance Heating & Air. If the third party warrantor does provide a labor allowance, the customer must still pay for labor at the time work is performed. If High Performance Heating & Air elects to process the claim for the labor allowance with the third party warrantor, credit will be issued to the customer after High Performance Heating & Air receives credit from the third party warrantor. Labor charges imposed by High Performance Heating & Air may be more than the labor allowance provided by the third party warrantor. The customer will not be reimbursed the difference.

Warranties On New Furnaces, Air Conditioners, Etc.

Warranties on new major pieces of equipment are usually dictated by the equipment manufacturer. For example a new residential air conditioner typically has a warranty of one year on labor and five years on parts. However, it's common for higher end equipment to exceed that minimum. Please refer to your contract or other equipment documentation to find out the exact length of your warranty. If no explicit written documentation can be found on a particular new part or new piece of equipment, it is likely that the standard warranty terms for repair work would apply. However, that is only an assumption and not a guarantee. Call if you need assistance on ascertaining what warranty coverage you have.

Warranties On Home Warranty Repairs

The warranty terms for repairs and installations performed by High Performance Heating & Air on behalf of First American Home Buyers Protection are defined by your contract with First American. Please consult your home warranty contract or call First American for details.
